Please read the following claims procedures and submit the duly completed claim form together with the relevant original documents to us. If necessary, we may require the employer and injured employee to provide further information or documentary proof for our claim assessment purposes.

Employee’s Compensation for Home Assistant
If your home assistant suffers accidental bodily injury arising out of and in the course of employment
  1. To seek medical examination or treatment by a registered medical practitioner at a hospital or clinic immediately, and then obtain the sick leave certificate and medical receipt from the registered medical practitioner.

  2. i)    If the accident results in total or partial incapacity of the employee for not exceeding 3 days
         and does not result in permanent incapacity, please complete and submit a prescribed
         Form 2B in duplicate to the Labour Department within 14 days of the accident. For details,
         please access the website of Labour Department's Employees’ Compensation Section.
         (i.e. the employer shall also notify and submit a copy of the Form 2B to us simultaneously);
                                                            or
    ii)   If the accident results in total or partial incapacity of the employee for exceeding 3 days or
          results in permanent incapacity, please complete and submit a prescribed Form 2 in duplicate
          to the Labour Department within 14 days of the accident. For details, please access the
          web site of Labour Department's Employees' Compensation Section. (i.e. the employer shall
         also notify and submit a copy of the Form 2B to us simultaneously)

  3. i)    Upon the expiry of sick leave, the employee should approach the Labour Department for sick
          leave clearance and, where necessary, to arrange for further assessment to assess the
          permanent loss of earning capacity caused by the injury.
                                                           or
    ii)   For injuries involving only temporary incapacity for a period not exceeding 7 days, the
         employer may directly agree with the employee in writing or verbally as to the compensation
         payable for claim settlement. In this case, the employee is no need to approach Labour
         Department for sick leave clearance or medical assessment.

  4. Please follow all claims requisite procedures prescribed by the Labour Department within the statutory time limits. Upon the completion of aforesaid claim procedures, please submit the following documents to us as soon as possible
    i)    The Original Sick Leave Certificate(s);
    ii)   The Original Medical Receipt(s);
    iii)   For injuries involving only temporary incapacity for a period not exceeding 7 days, please
          submit the Original Agreement for Claim Direct Settlement which should be signed by both
          parties of the employer and employee (if applicable);
    iv)   The Original Certificate of Compensation Assessment (Form 5) issued by the Labour
          Department (if applicable);
    v)   The Original Certificate of Assessment (Form 7) issued by the Labour Department
          (if applicable).
Important notes:
  1. For fatal work accident, the employer should call our Claims Hotline as soon as possible for details of claims procedures.
  2. The employer should keep a copy of all submitted documents for future reference purposes.
  3. Under the current Employees’ Compensation Ordinance, the Chinese herbalist and bonesetter have not yet been recognized as "Registered Medical Practitioner". Therefore, any sick leave certificates or medical receipts issued by such parties will not be accepted.
 
Personal Accident Cover for Home Assistant

If your home assistant suffers accidental bodily injury whilst at work, please submit the following documents within 30 days of the accident
i)    A signed and completed Personal Accident Claim Form;
ii)   The Original Medical Examination or Treatment Report, Medical Receipt and Police Report
     (if applicable), etc.
